Pushwoosh, Inc. and its group of companies (“Pushwoosh, “Us”, “Our” or “We”) are committed to protecting the privacy of individuals who visit Our Website (as defined below) (“Visitors”, including you). This Website Privacy Policy (“Policy”) sets out how We collect and process personal information about Visitors when Visitors visit Our website at www.pushwoosh.com and its subdomains and such other sites as may be designated by Pushwoosh (each and collectively the “Website” or “Site”).

This Policy does not cover:

• Personal information We process in the course of doing business with Visitors, such as when Visitors engage with Us as an individual who has registered to use the Services as defined below (“Customers”), potential Customers, vendor, service provider, professional advisor, consultant or other third party in relation to the provision of the services offered through the Website, including by way of example, certain services relating to the development, transmission, analysis, and management of push notifications and email messages (the “Services”); or

• Personal information We process through Our products and Services on behalf of Our Customers – for example push notification or email and other communications information that is sent and processed through the Pushwoosh Site and Services.

1. Information We Collect

   Information Visitors Provide to Us on the Website:

   Visitors may give Us personal information through Our Website, for example, when Visitors make inquiries about Our products and Services, sign up for free, contact Us for support, request a quote, demo, or consultation, or explore career opportunities with Us, or when Visitors sign up for an online account or marketing communications. By signing up on the registration page or accepting an invitation from the main account, users agree to receive Pushwoosh communications via email. This includes automated notifications, marketing, product updates, and sales emails. Users can unsubscribe at any time.

   We may ask Visitors to provide specific information set out in an online inquiry form (for example, name, contact details, company name, country, profile information). Alternatively, Visitors may choose to provide additional information when Visitors communicate with Us or otherwise interact with Us, and We will keep copies of any such communications for Our records.

   Voice conversations with Our AI assistant. On certain pages of Our Website (for example, the demo page), Visitors may choose to start a voice conversation with Our AI-powered assistant directly in the browser, to ask questions about Our products and Services and to help Us understand their requirements. The assistant is identified as an AI system on the page before the conversation begins, and the conversation happens only if the Visitor chooses to start it.

   Before starting a conversation, Visitors are informed on the page that the conversation is transcribed. During the conversation:

   • audio from the Visitor’s microphone is processed in real time so that the assistant can understand and respond; a live transcript is displayed on the page as the conversation proceeds;

   • We do not retain audio recordings of the conversation. What We keep is the text transcript, together with the information the Visitor provides in the accompanying form (such as industry and project size) and during the conversation (such as details about their company, product, and requirements);

   • the transcript is used by Our sales team to respond to the Visitor’s inquiry, as described in the Use of Information section below.

   A Visitor may end the conversation at any time, and may choose to book a call with a member of Our team instead of, or in addition to, talking to the assistant.

   We do not create voiceprints or other biometric templates, and We do not use the Visitor’s voice to identify or authenticate them. Audio is processed only to enable the assistant to understand and respond during the conversation and to produce the transcript.

   Information We Collect Automatically through the Website and Services:

   We may also collect certain information through Our Website and Services by automated means such as IP addresses, browser type and operating system, referring URLs, information about Visitors visit including the URL clickstream to, through and from Our Website, download errors, number of Website visits, and other page interactions. We collect this information automatically through the use of various commonly used information-gathering technologies including cookies and web beacons, to collect information as users and Visitors navigate the Website and use the Services (“Web Site Navigational Information”). We use these technologies to analyze trends, administer Web sites and Services, track users’ and Visitors’ movements around Our Website and Services, serve targeted advertisements and gather demographic information about Our user and Visitor base as a whole. 2. Use of Information

   We may use the information We collect through Our Website for a range of reasons including to:

   • Provide, operate, optimize and maintain the Website;

   • Deal with Visitors’ online inquiries and requests, and to provide Visitors with information and access to resources or services that Visitors have requested from Us; this includes answering Visitors’ questions and qualifying inquiries through Our AI voice assistant, and producing transcripts of those conversations;

   • Review transcripts for quality assurance and to improve how We handle Visitor inquiries;

   • Manage Our Website and system administration and security;

   • Improve the navigation and content of Our Website;

   • Identify any server problems or other IT or network issues;

   • Process transactions and to set up online accounts;

   • Compile aggregated statistics about Site usage and to better understand the preferences of Our Site Visitors;

   • Carry out research and development to improve Our products and Services;

   • Send marketing communications to Visitors (in accordance with their communication preferences);

   • Customize content and layout of the Website;

   • Carry out other legitimate business purposes, as well as other lawful purposes about which We will notify Our users, Visitors, and Customers.

   How the AI voice assistant is used in Our process. The AI assistant answers Visitors’ questions and produces a transcript and a summary of the Visitor’s stated requirements. It does not decide whether a Visitor is accepted or refused as a customer, and it does not set pricing or terms. Where the output of a conversation is used to prioritize or route an inquiry, that output is reviewed and acted on by a member of Our team, who may reach a different conclusion. Visitors may contact Us at privacy@pushwoosh.com to ask for a conversation outcome to be reviewed by a person, to express their point of view, or to contest how their inquiry was handled.

2A. Legal Bases for Processing (EEA/UK Visitors)

Where the GDPR or UK GDPR applies, We process personal information on the following bases:

Where We rely on legitimate interests, We have assessed those interests against Visitors’ rights and freedoms, and Visitors may object to such processing at any time by contacting privacy@pushwoosh.com. Where We rely on consent, Visitors may withdraw it at any time without affecting the lawfulness of processing before withdrawal.

3. Information We Share

   We may share and disclose Visitors’ personal information to third parties in the following circumstances:

   • Within the Pushwoosh group of companies for the purposes outlined in this Policy.

   • To vendors and other third-party service providers who require access to Visitors’ personal information to assist in the provision of the Website, Our products and Services, and other business-related functions. These include hosting and cloud infrastructure providers, real-time communications providers, customer relationship management providers, and cloud AI service providers that process the contents of Visitor conversations on Our behalf, including Google, whose AI services power Our AI voice assistant. These providers process personal information on Our behalf and under Our instructions, under contractual terms that prohibit them from using it for their own purposes, including the training or improvement of their own AI models. Google may retain conversation data for a limited period (currently up to 55 days) solely for detecting violations of its usage policies, after which it is deleted.

   • We do not share the contents of Visitor conversations with Our AI assistant (transcripts) with third parties for those third parties’ own marketing or advertising purposes.

   • We may also disclose Visitors’ information to third parties: (a) where required by law or regulatory requirement, court order or other judicial authorization, (b) in response to lawful requests by public authorities, including for the purposes of meeting national security and law enforcement requirements; (c) in connection with the sale, transfer, merger, bankruptcy, restructuring or other reorganization of a business; (d) to protect or defend Our rights, interests or property, or that of third parties; (e) to investigate any wrongdoing in connection with the Website or Our Services; (f) to protect the vital interests of an individual.

   • With Visitors’ consent.

   We may also share personal information collected through the Website with third party companies so that they may offer products and services that We believe will be of interest to Visitors. We may also share personal information with third party advertising-serving companies to better target the adverts and other content displayed on Our Website and to provide offers We think may be of interest to Visitors. Visitors may opt-out of disclosure of Visitors’ information to third parties for direct marketing purposes – see the Choice and Opt-Out section below. In addition, third party advertisers may receive certain personal information about Visitors if Visitors click on advertisements displayed on the Website. If Visitors do not wish these third parties to process Visitors’ personal information, Visitors are advised to not click on these adverts.

4. Third party Sites

   Our Website may contain links to other websites which are outside Our control and are not covered by this Policy. While We try to link only to websites that share Our standards for privacy, We are not responsible for the content, security or privacy practices employed by other websites. If Visitors access other websites using the links provided, the operators of these websites may collect information from Visitors which will be used by them in accordance with their privacy policy, which may differ from Ours.Pushwoosh may provide bulletin boards, blogs, or chat rooms on the Website. Any personal information Visitors choose to submit in such a forum may be read, collected, or used by others who visit these forums, and may be used to send Visitors unsolicited messages. We are not responsible for the personal information Visitors choose to submit in these forums.On some pages of Our Website, such as Our blog, third parties may provide applications or plug-ins through Our Website which may track Visitors’ use of content, applications or plug-ins, or may customize content, applications and plug-ins for Visitors. For example, when Visitors share a post on Our blog using a social media sharing button (e.g. Facebook, LinkedIn), the social network that has created the button will record that Visitors have done this. If Visitors do not want the social network to collect this information about Visitors, then Visitors are advised to not use this feature.

5. International Transfers of Personal Information

   We and Our group companies are established in the United States and other countries, and We use service providers located in various countries. As a result, Visitors’ personal information — including, where applicable, conversation transcripts — may be transferred to, stored in, and processed in countries outside the Visitor’s country of residence, whose data protection laws may differ.

   Where We transfer personal information from the EEA, the UK, or Switzerland to a country that has not been recognized as providing an adequate level of protection, We rely on one or more of the following safeguards:

   • the European Commission’s Standard Contractual Clauses (and the UK International Data Transfer Addendum, where applicable), together with a transfer impact assessment and any supplementary measures identified as necessary; or

   • an adequacy decision, where one applies to the recipient country; or

   • the recipient’s certification under the EU–U.S. Data Privacy Framework, the UK Extension, or the Swiss–U.S. Data Privacy Framework, where applicable.

   Transfers to Google in connection with Our AI voice assistant are made under Google’s certification under the EU–U.S. Data Privacy Framework, with the EU Standard Contractual Clauses incorporated in Google’s data processing terms as a fallback.

6. Sensitive Data

   Pushwoosh does not knowingly solicit or collect, and Visitors should not provide, any information regarding Visitors’ medical or health condition, race or ethnic origin, political opinions, religious or philosophical beliefs or other Sensitive Data, as such term is defined in the Pushwoosh Terms of Service.

7. Children

   The Website is not directed at children under the age of 13. We do not knowingly solicit or collect personal information from children under the age of 13.

8. Visitors’ Choices and Opt-Outs

   Visitors can opt out of receiving marketing emails from Us at any time, or opt out from having Visitors’ contact information shared with third parties for direct marketing purposes. Visitors can opt out of Our marketing emails by clicking the ‘unsubscribe’ link at the bottom of Our marketing messages.Also, all opt out requests can be made by emailing Us at privacy@pushwoosh.com. Please note that it may take up to 10 days to remove Visitors’ contact information from Our marketing communications lists, so Visitors may receive correspondence from Us for a short time after Visitors make a request.Please note that some communications (such as service messages, account notifications, billing information) are considered transactional and necessary for account management and Visitors cannot opt out of these messages unless Visitors request to deactivate their Pushwoosh account.

9. Other data rights

   Pushwoosh takes reasonable steps to ensure that the data We collect is reliable for its intended use, accurate, complete and up to date. Visitors can email Us at privacy@pushwoosh.com if Visitors wish to access, correct, amend or delete any personal information that We hold about Visitors and We will consider Visitors’ request in accordance with applicable laws.

10. U.S. State Privacy Rights (Including California)

Where Visitors are residents of California or of other U.S. states with comparable privacy laws, this section applies to personal information We collect through the Website, including through inquiry forms and voice conversations with Our AI assistant.

Categories collected. Identifiers (name, email, telephone number); commercial information (products and services of interest); professional or employment-related information (company, role, industry, project size); electronic information (conversation transcripts); inferences drawn from the above (for example, whether an inquiry matches Our service offering — such inferences are drawn from what Visitors tell Us, not from voice characteristics). We do not retain audio recordings.

Purposes. As set out in the Use of Information section above.

Sources. Directly from the Visitor, via the Website, including through voice conversations the Visitor initiates.

Disclosure. We disclose these categories to the service providers and contractors described in the Information We Share section above, for the business purposes described in the Use of Information section above.

Sale and sharing. We do not sell conversation transcripts, and We do not share them for cross-context behavioral advertising. With respect to other categories of personal information, Visitors may opt out of the disclosure of their information to third parties for those third parties’ direct marketing purposes, as described in the Visitors’ Choices and Opt-Outs section above.

California “Shine the Light” (Cal. Civ. Code § 1798.83). California residents may request information about the disclosure of their personal information to third parties for those third parties’ direct marketing purposes. Because Pushwoosh allows Visitors to opt out of such disclosure (see the Visitors’ Choices and Opt-Outs section above), Pushwoosh falls within the statutory exception to this disclosure requirement.

Sensitive personal information. We do not use or disclose information collected during voice conversations for purposes other than those permitted under applicable state law for service-provider processing. We do not use the Visitor’s voice to infer characteristics about them.

Rights. Subject to the conditions in applicable law, Visitors have the right to know, access, correct, and delete personal information, and to be free from retaliation for exercising those rights. Requests may be submitted to privacy@pushwoosh.com.

11. Retention of Visitors’ Personal Information

We will retain Visitors’ personal information for the period necessary to fulfil the purposes outlined in this Policy unless a longer retention period is required or permitted by law, for legal, tax or regulatory reasons, or other lawful purposes.

For voice conversations with Our AI assistant:

• Audio is not retained. We do not store audio recordings of conversations; audio is processed in real time only.

• Transcripts and inquiry details are retained for up to 24 months from Our last substantive contact with the Visitor, after which they are deleted or anonymized, unless a longer period is required for the establishment, exercise or defence of legal claims, or the Visitor becomes a Customer — in which case retention is governed by Our Services Privacy Policy.

• Our AI provider may retain conversation data for a limited period solely for abuse monitoring, as described in the Information We Share section above.

Visitors may request deletion of their transcripts at any time by contacting Us at privacy@pushwoosh.com. We will comply unless We are required or permitted to retain the information for one of the reasons set out above, in which case We will tell the Visitor why.

12. Updates to This Policy

We reserve the right to change or update this Policy from time to time. If material changes are made, We will place a prominent notice on Our Website for at least 30 days prior to the change taking effect, and will update the last revised date at the top of this Policy. We encourage Visitors to regularly check back on this page to ensure Visitors are up to date with any changes.
